الآثار القانونية المترتبة على مسؤولية المعلم المدنية تجاه التلاميذ

ملخص البحث
أن أهمية دراسة المسؤولية المدنية للمعلم تتجلى في تشخيص أن القانون العراقي لم يخص المعلمين ، بالرغم من كونهم يشكلون قطاعاً كبيراً وهاماً فى المجتمع ، بنظام خاص فيما يتعلق بمسؤوليتهم المدنية، أي أنه لم يميزهم عن غيرهم ممن يكلفون بالرقابة كالوالدين كون المعلم أيضا مكلف بالرقابة على الاطفال والصبيان وتعليمهم.
المعلم يتعرض فى عمله لمخاطر عديدة لا تقل جسامة عن المخاطر التى يتعرض لها غيره كالطبيب والمهندس المعماري والمقاول ، وعلى الرغم من أن هناك دراسات عديدة ومستفيضة كُرست حول مسؤوليتهم المدنية ـ استناداً إلى ما يتعرضون له فى عملهم من مخاطر- فإن مسؤولية المعلم المدنية لم تحظ بنفس الدرجة من العناية والدراسة خاصة في الفقه القانوني العراقي.
أن الظروف الحالية التى تشهدها مؤسساتنا التعليمية (تعدد الفترات ـ ارتفاع كثافة الصفوف الدراسية ـ سوء المرافق التعليمية) والأهداف الطموحة التى يسعى المجتمع إلى تحقيقها ، تلقى على المعلمين أعباء كثيرة ـ حيث يتولون تعليم ورقابة أعداد ضخمة من الأطفال والصبيان فى سن حيوية ونشاط ـ تتعلق بالمحافظة على النظام المدرسي، وتحقيق الأهداف المرغوبة، هذه الأعباء تتطلب ضرورة دراسة جوانب مسؤولية المعلم ، ومحاولة البحث عن أفضل الوسائل التى تحكمها ، والبحث عن أفضل الحلول الممكنة لها.

Abstract :
That the importance of studying the civil responsibility of the teacher is reflected in the fact that Iraqi law did not belong to teachers, despite the fact that they constitute a large sector and important in the community in a special system with regard to their civil responsibility, that is not distinguish them from others who are assigned to control as parents that the teacher is also responsible for the control of children and boys And education.
The teacher is exposed in his work to many risks not less serious than the risks to others, such as the doctor, architect and contractor, and although there are many studies and devoted to the civil responsibility based on what are exposed to the work in the risk – the responsibility of the civilian teacher did not get the same Degree of care and study, especially in Iraqi jurisprudence.
The current conditions in our educational institutions (multiple periods of high density of classrooms and poor educational facilities) and the ambitious goals that the society seeks to achieve, the teachers have a lot of burdens, where the education and control of large numbers of children and boys at a critical age and activity related to the maintenance On the school system, and achieve the desired goals, these burdens require the need to study the aspects of responsibility of the teacher, and try to search for the best means governing them, and search for the best possible solutions to them
