دور الدستور في ضمان حقوق المرأة العراقية

يعد الدستور حقيقة ثابتة في مجتمعات الدول كافة لايمكن لدولة ما أن تتنصل منها بأي حال من الأحوال، وذلك يرجع إلى دورها الكبير في تنظيم حقوق وواجبات الأفراد في المجتمع بكافة مستوياتهم سواء أكانوا شعبا او حكومة. إن تمتع المرأة بالحقوق السياسية مسالة ذات أهمية بالغة في تنظيم المجتمع السياسي، وذلك ليس لكونها موضوعا يرتبط بتحديد طريقة ممارسة السلطة السياسية وكيفية إسهام المرأة في هذه الممارسة وبالتالي بيان أبعاد العلاقة بين الحكام والمحكومين فحسب بل لكونها أيضا من أكثر أنواع حقوق الإنسان أهمية لأنها لا تمثل مجرد حقوق، بل تمثل أيضا ضمانات أساسية للمواطن كي يتمكن من التمتع ببقية حقوقه الأخرى في الدولة. فدستور عام 2005 مثل أطار قانونيا يلزم الجميع إن المرأة العراقية أصبحت تتمتع بوضع مركزي في كافة مناحي الحياة الاجتماعية – السياسية ولايمكن إغفال أحقيتها بذلك طالما إن هناك قواعد قانونية لها صفة العلو على باقي القواعد القانونية الأخرى، من هنا جاءت أهمية هذا الموضع لبيان إن المرأة جزءا مهما من المجتمع, لذلك من الواجب أن تطبق بحقها كافة النصوص الدستورية الضامنة لأحقيتها بالمساواة والعدالة بين الجنسين.

Abstract
The constitution is a fixed fact in the societies of all countries. The state cannot evade it in any way because of its great role in organizing the rights and duties of individuals in society at all levels, whether they are a people or government. Women’s enjoyment of political rights is a matter of great importance in the organization of political society, not only because it is a matter of determining how political power is exercised and how women contribute to this practice and thus of explaining the dimensions of the relationship between rulers and the governed but also of the most important human rights because they do not represent rights, but also basic guarantees for the citizen to be able to enjoy the rest of his other rights in the state. The Constitution of 2005 represented a legal framework that obliged everyone that the Iraqi women have a central position in all aspects of socio-political life, and their rights cannot be ignored as long as there are legal rules that are superior to other legal norms. Hence the importance of this position to show that women are an important part of society, therefore, all constitutional provisions guaranteeing equality and justice between the genders must be applied to them.
